A SHOCKING Singaporean story....

Tell you what happened last week.

2 weeks ago a neighbor of mine, a widower, died leaving behind 2 children - one in JC the other still in secondary school. The man was involved in an road accident and died in hospital. His wife passed away 3 years ago. The relatives are poor and refused to take in these children. I've known this family since I was a young boy The boy and girl are my good friends. The father left a fully paid 2 room flat so we all figured that with some financial help, the girl will be able to make to university, graduate and support her brother.

Since I'm not working and know the family, my mom asked me to approach the neighbors to ask who might be able to help. $10, $20 or $50 ...or whatever small amount that can support the 2 children every month in addition to the assistance from CDAC and other govt sources. Surprisingly, although the neighbors are poor many were will to commit to small amounts to help these children. The total amount was $185.

I went to the home on Good Friday to tell the children about the good news and advice them on how to plan their monthly expenses and so on. While I was chatting with them, there was this loud knock on the door.

A woman (from accent can tell from PRC) was with a 2-yr old small child wanted to come into the house. We all didn't know who she was so we asked her what she wanted. The next thing she said was quite shocking. She said the flat belonged to her. Ridiculous...I asked the 'mad' woman to get lost and take her nonsense with her. Sh!e took out marriage cert and showed us she was married to the kids' late father. Apparently, after his wife's death my neighbor started another family with this PRC woman who is a PR. Now this woman wants two thirds of the HDB flat (her share and her child's share) - either sell off and get share of the proceeds or the kids pay her two-thirds the rental of the flat. She said she is very kind and will give 2 months for this to be sorted out. As a spouse and one child, she has right to two-thirds of the man's CPF.

The 2 kids who had to overcome the great grief over the death of their father now have to be confronted with this heartbreaking situations

You are right...they plug this PR wives claim on the share of HDB flat & CPF some years ago, after a heart wrenching case of this woman who lost her share of CPF money to the husband, 'discovered mistress' from PRC.

Really heart breaking story! Poor lady with two kids! How is she going to support two young kids!

My heart goes out to the affected children of the deceased. It's clear that the PRC stepmother is out for money, or why turn up right after the husband died. Under the law are they obliged to entertain her? Under HDB law, she is entitled to half of the flat, while her kid will get 1/6 of the flat. This is very unfair for the children if just a few years back, the mom's share of the flat have just been transferred to the dad upon her demise. Is there a case?

Actually having a will would have solved all this problem. But that said, many people don't have wills. Actually how the assets is distributed will follow the succession laws.

7. In effecting such distribution the following rules shall be observed:

If an intestate dies leaving a surviving spouse, no issue and no parent, the spouse shall be entitled to the whole of the estate.

If an intestate dies leaving a surviving spouse and issue, the spouse shall be entitled to one-half of the estate.
Rule 3
Subject to the rights of the surviving spouse, if any, the estate (both as to the undistributed portion and the reversionary interest) of an intestate who leaves issue shall be distributed by equal portions per stirpes to and amongst the children of the person dying intestate and such persons as legally represent those children, in case any of those children be then dead.
Proviso No. (1) — The persons who legally represent the children of an intestate are their descendants and not their next-of-kin.
Proviso No. (2) — Descendants of the intestate to the remotest degree stand in the place of their parent or other ancestor, and take according to their stocks the share which he or she would have taken.
Rule 4
If an intestate dies leaving a surviving spouse and no issue but a parent or parents, the spouse shall be entitled to one-half of the estate and the parent or parents to the other half of the estate.
Rule 5
If there are no descendants the parent or parents of the intestate shall take the estate, in equal portions if there be two parents, subject to the rights of the surviving spouse (if any) as provided in rule 4.
Rule 6
If there are no surviving spouse, descendants or parents, the brothers and sisters and children of deceased brothers or sisters of the intestate shall share the estate in equal portions between the brothers and sisters and the children of any deceased brother or sister shall take according to their stocks the share which he or she would have taken.
Rule 7
If there are no surviving spouse, descendants, parents, brothers and sisters or children of such brothers and sisters but grandparents of the intestate the grandparents shall take the whole of the estate in equal portions.
Rule 8
If there are no surviving spouse, descendants, parents, brothers and sisters or their children or grandparents but uncles and aunts of the intestate the uncles and aunts shall take the whole of the estate in equal portions.
Rule 9
In default of distribution under the foregoing rules the Government shall be entitled to the whole of the estate.

That's right the law is the law. It's not the kids fault obviously but if you sign something over willingly like your assets of course the other party has a right to claim them.

Perhaps they should check on the authencity of the marriage claim why would a man just simply marry a woman out of the blue in secret?
